Terms of Service

These Terms of Service (“Terms”) govern your use of the websites, services, systems, marketing assets, software workflows, automations, consulting, strategy, lead generation support, advertising support, CRM configuration, website services, and related business services provided by HighPeaks Growth (“Company,” “we,” “us,” or “our”).

By accessing our website, submitting a form, booking a call, signing an agreement, making payment, or using our services, you agree to these Terms.

If you do not agree, you should not use our website or services.


1. Services Provided

HighPeaks Growth provides business growth, marketing, automation, CRM, lead generation, website, branding, advertising, and operational support services.

Services may include, but are not limited to:

  • Website design or landing page development

  • Marketing funnel setup

  • CRM setup and automation workflows

  • Lead intake systems

  • Appointment booking systems

  • SMS and email automation

  • Paid advertising support

  • Campaign strategy

  • Sales process support

  • Client onboarding systems

  • Business consulting

  • Lead nurturing and follow-up systems

  • AI-assisted intake or communication tools

  • Exit package or system handoff services

The specific services provided will depend on the agreement, proposal, package, invoice, or written scope accepted by the client.


2. No Guarantees

HighPeaks Growth does not guarantee specific business results.

This includes, but is not limited to, guarantees regarding:

  • Revenue

  • Profit

  • Sales volume

  • Booked appointments

  • Closed deals

  • Lead volume

  • Lead quality

  • Conversion rates

  • Ad performance

  • Return on ad spend

  • Website traffic

  • Search rankings

  • Customer acquisition costs

  • Business growth

  • Client retention

  • Platform approvals

  • Advertising account performance

Marketing results depend on many factors outside our control, including offer quality, pricing, reputation, sales follow-up, market demand, competition, budget, customer service, business operations, platform changes, and client execution.

Any examples, projections, estimates, case studies, or performance discussions are provided for informational purposes only and are not promises of future results.


3. Client Responsibilities

The client is responsible for providing accurate, complete, and timely information needed to perform services.

Client responsibilities may include:

  • Providing access to required platforms

  • Supplying brand assets, logos, photos, service details, pricing, and business information

  • Reviewing and approving materials

  • Responding to leads in a timely manner

  • Honoring booked appointments

  • Maintaining proper licenses, insurance, permits, and legal authority to operate

  • Ensuring claims made about their business are accurate

  • Paying invoices on time

  • Maintaining active subscriptions for required third-party tools

  • Following applicable laws and platform rules

HighPeaks Growth is not responsible for delays, lost opportunities, poor performance, or compliance issues caused by the client’s failure to provide information, approvals, access, payment, or proper follow-through.


4. Client Accuracy and Legal Compliance

The client represents that all information provided to HighPeaks Growth is accurate, lawful, and not misleading.

The client is responsible for ensuring their business complies with all applicable laws, regulations, licensing rules, industry standards, privacy laws, consumer protection rules, advertising rules, and platform policies.

HighPeaks Growth may assist with general marketing language, automation structure, and compliance-friendly wording, but we do not provide legal advice.

The client should consult qualified legal counsel for legal, regulatory, employment, tax, financial, or compliance advice.


5. Payments and Billing

All fees, deposits, setup costs, retainers, performance fees, installment payments, and other charges are due according to the accepted proposal, invoice, agreement, or payment terms.

Unless otherwise stated in writing:

  • Setup fees are due before work begins.

  • Monthly retainers are due in advance.

  • Payments are non-refundable once work has started.

  • Late payments may result in service suspension.

  • Past-due accounts may incur late fees where permitted by law.

  • Reinstatement may require payment of all outstanding balances.

  • HighPeaks Growth may pause or terminate services for nonpayment.

Client remains responsible for all agreed fees, even if the client does not fully use the services or fails to provide required access, assets, feedback, or approvals.


6. No Refund Policy

Due to the custom nature of marketing, automation, consulting, strategy, website, CRM, and system-building services, payments are generally non-refundable.

This includes payments for:

  • Setup work

  • Strategy work

  • Consulting

  • Website or landing page development

  • CRM configuration

  • Automation workflows

  • Campaign setup

  • Copywriting

  • Design work

  • System implementation

  • Monthly service retainers

  • Digital assets

  • Completed or partially completed work

Refunds, credits, or service adjustments may be provided only at the sole discretion of HighPeaks Growth.


7. Advertising Spend and Third-Party Costs

Unless expressly stated otherwise, client is responsible for all third-party costs, including:

  • Advertising spend

  • Domain purchases

  • Hosting fees

  • CRM subscription fees

  • Software fees

  • SMS and phone usage fees

  • Email platform fees

  • Payment processing fees

  • AI tool usage fees

  • Design asset purchases

  • Stock media

  • Plugin or app fees

  • Platform subscriptions

HighPeaks Growth is not responsible for charges billed directly by third-party platforms.

Advertising spend is paid to the advertising platform, not to HighPeaks Growth, unless otherwise stated in writing.


8. Third-Party Platforms

Our services may rely on third-party platforms, including but not limited to:

  • GoHighLevel

  • WordPress

  • Hostinger

  • Meta/Facebook

  • Google

  • Microsoft Clarity

  • Stripe

  • Calendars and scheduling tools

  • Email and SMS providers

  • AI software providers

  • Analytics platforms

  • CRM tools

  • Website builders

HighPeaks Growth does not control third-party platforms and is not responsible for:

  • Platform outages

  • Account bans or restrictions

  • Policy changes

  • Feature changes

  • Pricing changes

  • Data loss caused by third parties

  • Integration failures

  • Approval delays

  • Deliverability issues

  • Tracking discrepancies

  • Software errors

  • Platform downtime

Client agrees that third-party platforms may affect performance and service availability.


9. SMS, Email, and Communication Compliance

Client is responsible for ensuring that all contacts, leads, customers, and prospects contacted through SMS, email, phone, or automated systems have been collected and contacted lawfully.

Client agrees to comply with applicable communication laws and standards, including where applicable:

  • TCPA

  • CAN-SPAM

  • CTIA guidelines

  • Carrier messaging rules

  • State privacy and marketing laws

  • Platform-specific communication policies

HighPeaks Growth may help configure SMS, email, and automation systems, but the client remains responsible for lawful use of those systems.

Client must not upload, import, or contact lists obtained unlawfully, purchased without proper consent, scraped without authorization, or used in violation of applicable law.


10. Lead Generation Disclaimer

If HighPeaks Growth provides lead generation, appointment-setting support, intake systems, follow-up systems, or marketing campaigns, the client understands that leads are not guaranteed to convert into paying customers.

A “lead,” “inquiry,” “appointment,” or “opportunity” does not guarantee:

  • A sale

  • A signed contract

  • A qualified buyer

  • A purchase decision

  • Immediate availability

  • Accurate customer-provided information

  • Customer responsiveness

  • Customer attendance

  • Customer ability to pay

HighPeaks Growth is not responsible for missed sales caused by client response time, pricing, reputation, service quality, follow-up process, communication style, availability, or operational issues.


11. Sales Responsibility

HighPeaks Growth may help create systems that support sales and follow-up, but the client remains responsible for closing sales unless otherwise stated in writing.

Client is responsible for:

  • Answering calls

  • Responding to inquiries

  • Following up with leads

  • Attending appointments

  • Providing accurate quotes

  • Handling customer objections

  • Completing services

  • Maintaining customer satisfaction

  • Collecting payments from customers

HighPeaks Growth is not liable for revenue lost due to client sales performance or operational execution.


12. Service Timelines

Any timelines, launch dates, completion dates, or delivery estimates are estimates only unless expressly guaranteed in writing.

Timelines may be affected by:

  • Client delays

  • Missing information

  • Platform delays

  • Third-party approval processes

  • Technical issues

  • Scope changes

  • Payment delays

  • Revisions

  • Access issues

HighPeaks Growth is not responsible for delays caused by the client or third-party platforms.


13. Revisions and Scope Changes

Services include only the work described in the accepted proposal, invoice, agreement, or written scope.

Additional requests may require additional fees.

Scope changes may include:

  • Additional pages

  • Additional automations

  • Additional campaigns

  • Additional forms

  • New integrations

  • Extra revisions

  • New branding directions

  • Rebuilding approved work

  • Custom development

  • Emergency requests

  • Work outside the original service package

HighPeaks Growth reserves the right to decline work outside the agreed scope or provide a separate quote.


14. Intellectual Property

Unless otherwise stated in writing, HighPeaks Growth retains ownership of its pre-existing systems, frameworks, templates, workflows, copy structures, strategy processes, internal methods, documentation, automation logic, and proprietary business materials.

Upon full payment, the client may receive a license to use deliverables created specifically for the client.

Deliverables may include:

  • Website copy

  • Landing pages

  • Marketing materials

  • CRM workflows

  • Forms

  • Email/SMS templates

  • Funnel assets

  • Brand assets

  • Campaign structures

Client may not resell, redistribute, copy, white-label, or transfer HighPeaks Growth systems, templates, or proprietary materials unless expressly permitted in writing.


15. Exit Packages and System Handoff

If the client purchases an exit package, system handoff, or transfer package, the specific assets included will be defined in writing.

An exit package may include some or all of the following:

  • Landing page files or access

  • CRM workflow exports where available

  • Automation documentation

  • Form structures

  • Copy assets

  • Brand materials

  • Domain transfer assistance

  • Account handoff support

  • System usage instructions

HighPeaks Growth is not responsible for future performance, maintenance, platform changes, broken integrations, third-party fees, or client misuse after handoff.

Final handoff may require full payment of all outstanding balances.


16. Portfolio Rights

Unless the client requests otherwise in writing, HighPeaks Growth may display non-confidential work samples in its portfolio, case studies, sales materials, social media, or website.

This may include:

  • Website screenshots

  • Funnel screenshots

  • Design samples

  • Public-facing copy

  • General campaign descriptions

  • Non-sensitive performance summaries

HighPeaks Growth will not intentionally disclose confidential business information, private customer information, or sensitive internal data without permission.


17. Confidentiality

Both parties agree to take reasonable steps to protect confidential information shared during the business relationship.

Confidential information may include:

  • Business strategies

  • Customer data

  • Internal processes

  • Financial information

  • Login credentials

  • Non-public marketing data

  • Proprietary systems

  • Private communications

Confidentiality obligations do not apply to information that is publicly available, independently developed, already known, or required to be disclosed by law.


18. Access and Credentials

Client may provide access to websites, CRMs, ad accounts, domains, hosting accounts, social media pages, analytics platforms, email systems, or other tools.

Client is responsible for maintaining ownership and security of their accounts.

HighPeaks Growth is not responsible for damages resulting from:

  • Weak passwords

  • Shared login misuse

  • Unauthorized access

  • Client-side security failures

  • Third-party breaches

  • Revoked access

  • Account ownership disputes

Client should use secure access methods whenever possible.


19. Data Collection and Privacy

Use of HighPeaks Growth services may involve collection, storage, processing, and transmission of customer or lead data.

Client agrees to use all collected data lawfully and in accordance with applicable privacy laws.

Client must maintain appropriate privacy policies, consent language, opt-in disclosures, and customer data practices.

Use of our website and services is also governed by our Privacy Policy.


20. Prohibited Uses

Client may not use HighPeaks Growth services for:

  • Illegal activity

  • Fraudulent activity

  • Misleading advertising

  • Unauthorized spam

  • Harassment

  • Discrimination

  • Defamation

  • Infringement of intellectual property

  • Sale of illegal products or services

  • Collection of data without proper consent

  • Violation of platform policies

  • Misrepresentation of services, pricing, credentials, or guarantees

HighPeaks Growth reserves the right to refuse, suspend, or terminate service for prohibited use.


21. Suspension or Termination

HighPeaks Growth may suspend or terminate services if:

  • Client fails to pay

  • Client violates these Terms

  • Client misuses systems

  • Client engages in unlawful conduct

  • Client damages or risks damaging our reputation

  • Client fails to provide required access or cooperation

  • Client requests work outside legal or ethical boundaries

  • Client becomes abusive, threatening, or unprofessional

  • Third-party platforms restrict required accounts

Termination does not eliminate the client’s responsibility to pay outstanding balances.


22. Chargebacks and Payment Disputes

Client agrees to contact HighPeaks Growth directly before initiating a chargeback or payment dispute.

Improper chargebacks may result in:

  • Immediate service suspension

  • Termination of access

  • Collection of outstanding balances

  • Recovery of chargeback fees

  • Legal or collection action where permitted by law


23. Client Results and Testimonials

If the client provides testimonials, reviews, feedback, screenshots, performance data, or written statements, the client grants HighPeaks Growth permission to use them for marketing purposes unless revoked in writing.

HighPeaks Growth may edit testimonials for length or clarity but will not intentionally alter their meaning.


24. Limitation of Liability

To the maximum extent permitted by law, HighPeaks Growth shall not be liable for:

  • Lost revenue

  • Lost profits

  • Lost leads

  • Lost opportunities

  • Business interruption

  • Platform outages

  • Advertising account restrictions

  • Data loss

  • Customer disputes

  • Third-party failures

  • Indirect damages

  • Incidental damages

  • Consequential damages

  • Punitive damages

Our total liability for any claim shall not exceed the amount paid by the client to HighPeaks Growth for the specific service giving rise to the claim during the three months preceding the claim.


25. Indemnification

Client agrees to indemnify, defend, and hold harmless HighPeaks Growth, its owners, contractors, vendors, agents, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from:

  • Client’s business operations

  • Client’s products or services

  • Client-provided information

  • Client’s violation of law

  • Client’s misuse of our services

  • Client’s communication with leads or customers

  • Client’s advertising claims

  • Client’s breach of these Terms

  • Customer disputes involving the client


26. No Professional Advice

HighPeaks Growth does not provide legal, tax, accounting, financial, employment, insurance, or regulatory advice.

Any information provided is for general business and marketing purposes only.

Client should consult licensed professionals for professional advice.


27. Force Majeure

HighPeaks Growth shall not be liable for delays or failures caused by events outside our reasonable control, including:

  • Natural disasters

  • Power outages

  • Internet outages

  • Platform outages

  • Labor disruptions

  • Government actions

  • War

  • Civil unrest

  • Cyberattacks

  • Payment processor issues

  • Third-party service failures


28. Governing Law

These Terms shall be governed by the laws of the State of North Carolina, without regard to conflict of law principles.

Any disputes shall be handled in the appropriate courts located in North Carolina unless otherwise required by law or agreed in writing.


29. Changes to These Terms

HighPeaks Growth may update these Terms at any time.

Updated Terms will be posted on this page with a revised effective date.

Continued use of our website or services after updates constitutes acceptance of the revised Terms.
